Before being murdered at the hands of her ex-partner in a square in Figueres (Girona) on the afternoon of Tuesday the 19th, before the eyes of various people who recorded everything and made it viral on social networks, Kimberli DG, a 32-year-old Honduran trans woman, had already reported her attacker to the Mossos d’Esquadra on Sunday the 17th. In the report that the agents presented to the magistrate of square number 7 in Figueres (Girona), Violence Against Women) is listed as detained “for mistreatment of gender violence” and Kim, according to the court order this Friday, “expressly requested a protection order.” The victim had “bruises and wounds on the face, erythema on the neck due to pressure, chest due to abrasions and wounds on the lower lip and the detainee, Andrés RC, 48 years old and Spanish, had a knife with a 10.5 cm blade used. However, in the police risk assessment questionnaire, it is stated: “Unappreciated level of risk of suffering a serious physical attack at the current time.” The detainee had already served prison time previously for injuries and mistreatment of another couple.

In the report, the victim reported that the aggressor pulled her hair, hit her multiple times, pulled out a knife, threatened her and grabbed her by the neck. In addition, the order states, various convictions related to gender violence and even two convictions for bankruptcy, not related to this victim, were also provided.

On Monday morning, the 18th, a quick trial was held in Plaza 7 of the Court of First Instance of Figueres with a compliant sentence in which the aggressor accepted a sentence of six months, a ban on possession of weapons for 1 year and 8 months, and a ban on communication and getting closer than 250 meters to the victim for 1 year and 4 months. In the same sentence, the suspension of the custodial sentence and the release of the convicted person were agreed. There is no evidence that the victim was heard before the compliance or the suspension of the sentence.

That same afternoon, an ambulance returned to the occupied house that the victim and defendant initially shared. He had beaten her brutally: he had tried to strangle her and hit her with a fire extinguisher. The Urban Police summoned her at 10:30 a.m. in Plaza 5 of the Figueres court to testify and carry out a forensic examination. He was arrested and spent the night in the Mossos dungeons.

On the morning of the 19th, he picked up this Friday’s car from the magistrate of Plaza 5. The report did not include any details of the victim’s injuries and he did not attend the appointment with the forensic doctor for an examination. However, sources close to the case claim that she went to look for the injury report at the Figueres Hospital and was referred to the Primary Care Center (CAP) where she finally picked it up. Although according to the same order, the victim “did not attend the judicial summons designated as a quick trial at 10:30 a.m. and at 12:45 p.m. the lawyer from the Administration of Justice, to state that he had not appeared before the court on duty and that he did not answer a telephone call.” That morning, several witnesses located the victim, “scared and looking everywhere,” in Court 7 for Violence against Women. He did try to attend the summons, although for some unfortunate reason he did not reach the correct court.

After being arrested for the crime, the alleged murderer has gone before the head of Square 5, and the prosecutor has requested his entry into prison as the alleged perpetrator of a crime of murder with treachery. The private accusation brought by the victim’s mother has been supported. After hearing his statement, the judge has sent him to prison as the alleged perpetrator of intentional homicide and breach of sentence.

When questioned by the magistrate, the detainee acknowledged the facts and gave his version of them. He has maintained that after being released on Tuesday the 19th at around one in the afternoon, he bought a carton of wine and drank it with two transiliums and he walked towards Txots (a tavern) and near there he met Kimberli. He told him to see if they could talk, they went to buy another carton of wine – which are the images that spread on the networks – and they went to a bench in Plaza Josep Tarradellas, where, according to him, they mixed it with tranquimazin.

Then, Andrés R. began to ask Kim what he had done during the hours he was in the dungeons. According to his version, she did not want to answer him and he finally managed to get hold of her cell phone and found out that she was having an affair with a neighbor. This extreme, according to sources close to the investigation – has not been verified and would be in the detainee’s imagination. Then, he detailed, he returned the phone, went to a “Chinese” store and stole a knife – with a blade of 16 centimeters and 5 centimeters wide – and, out of anger, he suddenly no longer remembers anything else. The next memory he says he has is of Kim on the ground and people shouting at him: “That you killed her, that you killed her.” When he began to ask the prosecutor, he decided that he was no longer answering any more questions.
