Judge Carolina García Durrif, head of the Violence Against Women Court Number 12 in Madrid, informed former deputy Íñigo Errejón this Monday that she has archived the second complaint filed against him at the end of February for an alleged case of sexual assault. In a ruling, to which this newspaper has had access, the magistrate has rejected the request of Errejón’s defense to appear in the case because “the proceedings have been archived by a resolution dated today as the victim has not ratified her complaint.”
The lawyer of the woman who reported, Alfredo Arrién, has informed this newspaper that, at the moment, his office has not received said notification. However, it was a foreseeable event. Arrién himself reported last Friday that the provisional filing of the complaint would be “shortly” because his client – whose identity is unknown – decided not to ratify the complaint last week. The reason, according to her lawyer, was that she had requested the status of protected witness because she is an “actress of recognized public notoriety and projection,” but the magistrate had not granted it to her.
The complaint, filed at the end of February and to which this newspaper had access, indicates that the events occurred in October 2021, at the former politician’s home, after the woman refused to have sexual relations. “In a surprising and violent manner, the accused held her by the neck, placed her on her back and forcibly penetrated her vaginally, without her consent and despite the fact that the complainant repeatedly shouted for him to stop. The penetration continued for several minutes until the accused finally stopped,” appears in the text.
The woman’s lawyer, who claims that she had a romantic relationship with the former leader of Sumar, is the same lawyer who represents the actress Elisa Mouliaá, the first complainant who accused Errejón of sexual abuse and whose case is pending trial. In this second complaint, Arrien has requested the status of protected witness for his client, since the complainant is an “actress of recognized public notoriety and projection.”
The facts of this second complaint against Errejón date back to October 16, 2021. The complainant relates that that day she was at a wedding in Madrid, in the La Moraleja urbanization, and the then deputy, according to the complainant’s version, proposed that they go together to another party in Móstoles. She agreed and the politician paid for the taxi. Already there, both, under the influence of alcohol, entered the bathroom of a bar, “where the accused insisted that the complainant perform fellatio on him,” according to the complaint, which adds: “In a context of pressure, consumption of alcohol and cocaine – a substance that both inhaled – the complainant reluctantly agreed.”
Afterwards, the two left the premises to go to Errejón’s house in the car of one of his friends. “During the journey, the accused began to insert his fingers into her vagina without her consent. The complainant expressly expressed her refusal, saying that she did not want to and trying to physically move away, resulting in a struggle,” the document states. The former deputy persisted and, according to the complainant, he got close to her ear and told her: “If you resist it will be worse.”
The complainant’s story indicates that at this moment she was in a state of blockage and, under pressure from the accused, she agreed to go up to her home and performed oral sex on him in the building’s entrance and in the elevator. Once inside Errejón’s house, she describes that he raped her. After reproaching him for what he had done, he left the building.
The two met again on another occasion, in which Errejón continued “persisting in extreme control behaviors, demanding the sending of the location in real time and making insistent calls.” The complainant’s lawyer describes in the complaint that his client went once again to the defendant’s house and they had sexual relations “in which she felt deeply uncomfortable.” She ended the relationship, although, as appears in the description of the events, Errejón told her that the relationship would end “when he wanted and not when she wanted” and maintained contact with her on social networks until January 6, 2022.
